BUSINESS IMMIGRATION


The point based system was meant to be simple and straight forward but in fact it is not, and even a minor mistake may result in the refusal of application or dismissal of the appeal / judicial review claim, resulting in making it even more complex. Initial Applications: We can advise and represent our clients in making their initial application which can be made either from overseas or from inside the UK depending on the factor whether he / she is eligible to switch to this category or not.

An entrepreneur and graduate entrepreneur are required to score 95 points from three different areas, namely, attributes (a minimum of 75 points), English Language (10 points) and maintenance (10 points).

A person with an investor visa is required to score 75 points for attributes. These categories are NOT subject to the English language and maintenance requirements in order to obtain entry clearance.

    Tier 1

  • Tier 1 Entrepreneur Visa

This is called the ‘business person’ route into the UK. The individual or team of two entrepreneurs must be investing in the UK.

How?

By setting up a new business or joining or taking over an existing business. Minimum amount that is needed for an investment in a business is £200,000 from any source or £50,000 from a Home Office approved source such as a registered and regulated ventured capital firm.

  • Tier 1 Investor Visa

This category is for an individual who is able to make a substantial financial investment of at least £2 million in the UK.

  • Tier 1 Graduate entrepreneur

This category allows a graduate from a Home Office-approved UK Higher Education Institution, who has been identified as having developed world-class innovative ideas or entrepreneurial skills, to stay in the UK after graduation to establish one or more business in the UK. Leave is normally only for 12 months, and then the person is expected to depart the UK or to switch into another category, such as entrepreneur.
